As a political activist, you must know your rights. No one can stop you from peacefully distributing political literature on public property. Public property includes all parks, sidewalks, streets, etc. The people who patrol theses areas may try to stop you but dont listen to them. Only stop if they arrest you and then you can sue your city. It is very important that you plead innocent if you plan to file a lawsuit.
Even though your school is a public school, your administrators and teachers may have the right to stop you from distributing literature on school grounds. If you are stopped, then distribute the flyers on the sidewalk directly in front of your school. You do not need to walk down the block or stand across the street from your school.
If you are arrested (which I doubt will happen), there are lawyers who will volunteer their services to defend your First Amendment rights and help you sue your city for thousands of dollars. Contact the ACLU if you need free legal services. The ACLU routinely represents activists.
Read about two instances in which Libertarians were wrongly arrested for distributing literature. In Florida, the Libertarian won $25,000 and in New Jersey, the charges were dropped. |
